Terms of Use, Proprietary Rights & Limitation of Liability

1. Purpose and Nature of the Tool

The PFAS Treatment Calculator (the "Tool") is provided for preliminary estimation and general informational purposes only. The calculations generated, including but not limited to Empty Bed Contact Time (EBCT), media consumption rates, and burn rates, are based on idealized mathematical models and user-provided data.

2. No Guarantee of Performance

PFAS chemistry is complex and highly site-specific. The Company does not guarantee that the results generated by the Tool will reflect actual field performance. Factors including, but not limited to:

  • Fluctuating influent concentrations
  • Presence of Co-Contaminants or Total Organic Carbon (TOC)
  • Water temperature and pH levels
  • Specific isomers of PFAS present

...can significantly alter the efficacy of treatment media. The Company makes no warranty, express or implied, regarding the "breakthrough" timing or the ability of any media to meet specific regulatory discharge limits.

3. User Responsibility & Professional Advice

The User acknowledges and agrees that:

  • Professional Oversight: The results of this Tool do not substitute for a professional engineering evaluation or bench-scale/pilot-scale testing.
  • Monitoring: The User is solely responsible for the design, implementation, and rigorous monitoring of any treatment system. Regular sampling and laboratory analysis are required to ensure compliance with local, state, and federal regulations.
  • Regulatory Compliance: It is the User's sole responsibility to remain compliant with evolving PFAS standards.

4. Limitation of Liability

To the maximum extent permitted by law, PRM, its officers, and employees shall not be liable for any:

  • Direct, indirect, or consequential damages arising from the use or inability to use the Tool
  • Regulatory fines, penalties, or legal fees incurred due to treatment system failure
  • Environmental remediation costs or third-party claims related to PFAS discharge

The User's use of the Tool is at their own risk. By using this Calculator, the User waives any right to hold PRM liable for the accuracy or real-world application of the generated data.

5. Indemnification

The User agrees to indemnify and hold harmless PRM from any claims, losses, or liabilities (including attorney's fees) arising out of the User's reliance on the Tool's output or the failure of any system designed based on these calculations.

6. Proprietary Rights & Restricted Use

This Tool, including its underlying algorithms, data models, engineering methodologies, and all output generated, is the exclusive intellectual property of Product Recovery Management, Inc. This material is protected under applicable U.S. intellectual property laws, including copyright, trade secret, and unfair competition statutes.

Access to this Tool is restricted to PRM clients, authorized partners, and prospective customers evaluating PRM's PFAS treatment solutions. While this Tool is publicly accessible, public availability does not constitute a waiver of PRM's proprietary rights, nor does it place any content into the public domain.

The following activities are strictly prohibited without prior written authorization from PRM:

  • Commercial Benchmarking: Using this Tool's output, methodologies, or data to evaluate, compare, or calibrate competing products, services, or pricing models
  • Reverse Engineering: Decompiling, extracting, replicating, or attempting to derive the underlying algorithms, formulas, or engineering assumptions embedded in this Tool
  • Business Intelligence: Systematic collection or use of information from this Tool to inform competitive strategy, product development, or market positioning by any direct or indirect competitor of PRM
  • Unauthorized Reproduction: Copying, redistributing, or creating derivative works from any output or data obtained through this Tool

7. Competitor Notice

Direct competitors of PRM in the water treatment, PFAS remediation, or environmental services sectors are hereby placed on notice: Your access to and use of this Tool does not constitute authorization to exploit PRM's intellectual property for commercial advantage.

Any use of this Tool for commercial benchmarking, reverse-engineering, or business intelligence purposes may constitute misappropriation of trade secrets and/or unfair business practices under applicable state and federal law, including the Defend Trade Secrets Act (18 U.S.C. § 1836).

PRM reserves the right to pursue all available legal remedies, including injunctive relief, actual and punitive damages, and recovery of attorneys' fees against any party engaging in prohibited use.

8. Monitoring & Enforcement

PRM monitors access to this Tool. Usage patterns, access logs, and tool interactions may be reviewed to identify unauthorized or prohibited use. PRM reserves the right to restrict or terminate access to any user or entity found to be in violation of these terms, without prior notice.

Water quality significantly affects carbon life. Groundwater and wastewater applications see substantially fewer bed volumes due to competitive adsorption from background organics.

Long-chain compounds (PFOS, PFOA) have higher carbon affinity. Short-chain compounds (PFBS, PFHxS) break through much faster.
